ARTICLE 1 - ORGANISATION

1.1. AVR bv, with its registered office at 8800 Roeselare, Meensesteenweg 545 (hereinafter the Organiser), and with company number 0405.515.626, organises a Competition (hereinafter the Competition) which runs from 09/02/2022 to 01/05/2022 at midnight (for the submission of photos) and to 09/05/2022 at 12 noon (for the determination of the winner), Brussels time zone (hereinafter the Competition Period).
1.2. This Competition is announced via a post on the Organiser's Instagram and Facebook page.

ARTICLE 2 - GENERAL PROVISIONS CONCERNING THE COURSE

2.1. Participation in the Competition implies full knowledge and irrevocable acceptance, without any reservation, of the Contest Rules.
2.2. The Contest Rules are available on the website of the Organiser and upon simple request.
2.3. The Organiser reserves the right to make changes to the rules at any time, without having to justify its decision. These modifications will be applicable to each participant. No printing or typing errors can give rise to compensation or any obligation whatsoever on the part of the Organiser.
2.4. The Organiser reserves the right, without having to justify his decision, to terminate the Competition at any time if fraud is detected.
2.5. By participating in this Competition, participants unconditionally accept, without reserve, each and every article of these rules as well as any and all decisions to be made by the Organiser in the context of this Competition. All situations not expressly covered by these rules shall be settled by the Organiser.
2.6. Any complaints about this Competition should be sent directly to: AVR bv, "Calendar photo contest", Meensesteenweg 545, 8800 Roeselare.

ARTICLE 3 - PARTICIPATION IN THE COMPETITION

3.1. The person who, during the Competition Period, sends a photograph depicting an AVR planter and/or an AVR cultivator from the current range (and no other potato machine brands than AVR in the background) to communication@avr.be is a participant in this Competition.
3.2. The participant must be a natural person.
3.3 The participant agrees that any photo sent to AVR in the context of the photo contest may be considered by AVR as royalty free images and may therefore be used by AVR for promotional purposes.
3.4 The photograph must have a minimum size of 1 MB in order to be considered as a participating photograph.
3.5 The winning photograph will be included in the 2023 AVR Calendar.

ARTICLE 4 - DETERMINATION OF THE WINNER

4.1. The Organiser will make a first selection of the submitted photos. On Wednesday 4 May, the selection of the 5 best photos will be shared on the Facebook page of the Organiser. The winner will be determined by the number of likes. Voting is open until 12 noon on 09/05/2022. The Organizer will contact the winner personally.

ARTICLE 5 - PRIZE

5.1. The prize awarded to the winner may not at any time be questioned, nor can it be converted, in whole or in part, into cash, nor exchanged or replaced, for any reason whatsoever.
5.2. The Organiser reserves the right to convert the prize into a prize of similar value and - as far as possible - with similar characteristics. A prize is indivisible and must be accepted as allocated.
5.3. The prize is: 1 AVR Driverpack (body warmer, overall, polo shirt, measure tape, plush Puma). The winner will also be sent the 2023 calendar by post.
5.4 The prize will be sent to the winner.

ARTICLE 6 - EXCLUSION AND PROSECUTION

6.1. A person who nevertheless wins a prize without fully complying with all the conditions of participation will automatically lose his entitlement to the prize, without compensation and without any recourse against the Organiser.
6.2. The Organiser reserves the right to exclude any person who impedes the progress of this Competition and to prosecute any person who defrauds, falsifies, abuses, manipulates or defrauds the Competition as defined in these rules.

ARTICLE 7 - LIABILITY

The Organiser may not be held liable in the event that the Competition has to be modified or cancelled due to particular circumstances, such as, for example, internet problems that prevent or limit participation.

The Organiser excludes all liability for damages caused by its own fault, except for non-fulfilment of commitments which are one of the main provisions of these Contest Rules. The Organiser declines all responsibility in the event of an accident or incident occurring to the winner during the use or enjoyment of his/her prize.

ARTICLE 8 - PRIVACY

8.1. The personal data of the participants are processed in accordance with the applicable regulations, including the General Data Protection Regulation.
8.2. The person responsible for processing personal data is the Organiser and its suppliers. The personal data communicated upon participation in the Competition shall only be used for the purpose of handling the Competition (contractual legal basis). The Organiser will only use the winner's personal data for promotional purposes if a winner has expressly agreed to this (legal basis consent). Participants' data will only be shared with the Organiser's marketing and other service providers (such as, but not limited to, postal services, etc). However, data that is freely available on social media may be shared by the Organiser without the prior consent of the participant.
8.3. Winners' data will be retained for 10 years.
8.4. Participants have the right to access, correct and delete their data. Participants also have the right to request the Organiser to limit the processing of their personal data or to request the transfer of their data in a machine-readable format. Finally, participants have the right to lodge a complaint with the Data Protection Authority. To exercise his rights, the participant can contact AVR bv.
8.5. If the participant opposes the further processing of his/her personal data during the Contest, he/she shall be deemed to have irrevocably renounced his/her participation in the Contest.

ARTICLE 9 - LEGISLATION AND COURT

9.1. The present rules of the Competition as well as the actual running of the Competition are subject to Belgian law.
9.2. The courts in Kortrijk shall have jurisdiction to hear all disputes regarding the creation, validity, execution, adherence to and interpretation of the present Contest Rules.
9.3. In the event of a dispute regarding the application or interpretation of the Contest Rules, the customer undertakes to first seek an amicable solution in consultation with the Organiser before initiating legal proceedings.
9.4. The Dutch version of these Contest Rules is the only legally binding version.
